1 GENERAL
1.1 Uplink Mobile LLC., 30 N Gould ST STE R, Sheridan WY 82801, Wyoming, United States of America (hereinafter "Supplier"), offers XP-Play (xp-play.site), an Internet portal for games, applications, videos, wallpapers (hereinafter "Portal"), for mobile phones and other devices (mobile devices).
1.2 Xp-Play can be used with any Internet browser.
1.3 Products under the name Xp-Play can only be used if the customer is also a mobile network operator’s customer.
1.4 This product is provided solely on the basis of these General Terms and Conditions (hereinafter "GTC").

2 CONTRACT FORMATION
2.1 Any customer who owns a mobile phone or other terminal device that technically meets all usage requirements (functional Internet browser and Internet connection) and is a customer of a mobile operator can use Xp-Play products under the following conditions.
2.2 The customer is the recipient of the mobile bill. If others use the customer’s phone without their consent, the customer is responsible for the third party’s behavior. All costs caused by the third party must be paid by the customer.
2.3 If the customer requests a product made available on Xp-Play by entering their mobile phone number on the Internet platform, this shall be deemed an offer to conclude an agreement between the supplier and the customer for the use of the products.
2.4 The supplier may accept this offer either by providing or sending the requested product. This is usually done by sending a link to the ordered product to the WAP-enabled phone or by activating the right to use the product.
2.5 The supplier is free to accept or reject the offer at any time.

3 DELIVERY SERVICE
3.1 The supplier reserves the right to change, terminate, supplement, and/or expand any Xp-Play product in whole or in part.
3.2 Unless otherwise stipulated in these terms, the supplier’s duty is solely to provide the video material and/or deliver the requested product to the customer.
3.3 Once the requested products are delivered and/or sent, costs will be incurred by the customer in all cases, unless the product is expressly indicated as free of charge.

4 SUBSCRIPTION
4.1 In addition, the following rules apply to paid subscriptions offered by the provider.
4.2 The customer must pay a weekly fee for each subscription they use.
4.3 Each subscription includes only the content features listed in the description (e.g., category) and may require the listed prerequisites.
4.4 The subscription contract is in principle indefinite.
4.5 The supplier or the customer may terminate the agreement immediately on business days.
4.6 Refunds for subscription periods already started are not possible and will not be provided.
4.7 It is also possible to cancel a subscription until the end of the current subscription period. The supplier or customer may also use this cancellation option on business days.
4.8 In all cases, termination must be done in one of the following ways:
(a) via the “Cancel” button in the relevant customer account
(b) by email to [email protected]
with an exact description of the cancellation request, phone number, and the subscription used, including date of use;
(c) by calling the toll-free support center at 0923165143.
4.9 If the provider terminates the contract, the customer will be notified by email and/or SMS.
4.10 If the subscription price is increased as a result of one of the options listed in section 3.1, the customer is free to choose whether to continue the subscription or cancel it at no additional cost.

5 CUSTOMER RIGHTS AND OBLIGATIONS
5.1 The protection and careful handling of the customer’s personal data is very important to the provider. The privacy statement is therefore part of these terms.
5.2 Where information is collected from the customer, they must provide all data truthfully. Any future changes must be reported to the supplier immediately without request.
5.3 Unless additional information is specified in the subscription description, only the customer’s mobile phone number is collected, stored on European servers, and used solely within or on the basis of these contractual obligations. This includes the fulfillment and enforcement of the contract with the customer.
5.4 The customer may at any time request the deletion of stored personal data using one of the options listed in section 4.8.
5.5 All customer data collected by the provider will be deleted immediately after the subscription ends.
5.6 The customer must pay the applicable weekly costs for each subscription used.
(a) If the customer has a long-term contract with their mobile operator, the subscription costs will be charged to the customer’s mobile phone bill.
(b) If the customer uses a prepaid card, the subscription costs must be paid immediately and deducted from the prepaid balance, provided sufficient balance is available. Otherwise, the service cannot be used. In this case, no money will be deducted from the prepaid card and no contract will be concluded.
5.7 The customer is responsible for payments to their mobile operator and/or Internet provider as soon as they access products in the Xp-Play area and/or when products are transferred to their device (e.g., products downloaded via a WAP connection).
5.8 If the customer breaches these terms, they agree to compensate the supplier for all damages arising from the breach.
5.9 Furthermore, the customer agrees to indemnify the supplier against any third-party claims resulting from the customer’s actions and to cover all resulting damages at their own expense.

7.2 Otherwise, the supplier is liable only if the supplier itself and/or one of its employees, representatives, or agents has violated an essential contractual obligation through slight negligence. In this context, liability for damages is limited to immediate and foreseeable damages. Indirect or atypical consequential damages are not compensated.
7.3 The provider does not operate its own mobile network. Therefore, third-party services (e.g., mobile operators) must be used. From time to time, technical difficulties may occur with these third-party providers, which may result in transmission disruptions and thus temporary restrictions or unavailability of the provider’s services. In this context, it must be emphasized that the provider cannot guarantee the sending or receiving of SMS or the receipt of products from the provider.

8 COPYRIGHT
8.1 All materials found in the Xp-Play area—particularly images, photos, videos, logos, and texts/fonts—are protected by copyright. In this context, the supplier has been granted all locally and territorially restricted usage rights.
8.2 Use of these protected works/services is permitted only for private use.
8.3 All commercial use is strictly prohibited unless the supplier has granted prior written consent.

9 RIGHT OF WITHDRAWAL
9.1 The customer has the right to cancel any contract concluded in connection with a subscription within fourteen (14) days without giving any reason.

9.6 The customer may use the cancellation template at the end of these terms, which is not mandatory.
9.7 The customer may also create, complete, and send their own cancellation form.
